Terms of Service

Please read these Terms of Service ("Terms") carefully before using the UlarCard application, sync services, and related websites ("Service"). By accessing or using UlarCard, you agree to be bound by these Terms.

1. Description of Service

UlarCard is a personal spaced-repetition flashcard and study system built around the FSRS scheduling algorithm. It provides study workflows across mobile, desktop, and terminal platforms. The Service offers a Free tier with local capability and limited sync, as well as paid subscription tiers with expanded sync card limits and cloud features.

2. License to Use

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use UlarCard on your compatible devices in accordance with the application store terms (Apple App Store, Google Play) and these Terms.

3. Local-First Architecture and User Responsibility

UlarCard operates on a local-first model. Your flashcards, study logs, and schedules are stored locally on your device in a local database.

• Data Backup: You are responsible for maintaining local backups of your data using the built-in backup export feature. We are not liable for data loss caused by hardware failure, operating system corruption, device loss, or accidental user deletion.
• Protected Decks (End-to-End Encryption): Cards in protected decks are encrypted client-side using your master password before being stored or synced. We do not possess the keys to decrypt your protected content. If you lose or forget your master password, your encrypted cards cannot be recovered by us.

4. Spaced Repetition and Learning Disclaimer

UlarCard provides review scheduling suggestions computed via the FSRS algorithm. These schedules are statistical recommendations to assist personal memorization and study. We do not warrant or guarantee any specific learning outcome, exam result, or retention rate.

5. Accounts, Sync, and Data Lifecycle

5.1 Account Registration

You may use UlarCard anonymously in local-only mode. Connecting to cloud sync requires authentication via email one-time token or Google sign-in.

5.2 Card Limits

Cloud synchronization is subject to active card limits defined by your plan tier (e.g., Free tier syncs up to 300 active cards). When your active cards exceed the tier sync limit, newly created cards remain functional locally but are paused from uploading until upgraded or within limits.

5.3 Subscription Expiration and Server Data Retention

• When a paid subscription expires, your account is transitioned to the Free tier. Your existing server cards are not immediately deleted, and synchronization continues within Free tier limits.
• Server-stored collections and remote media for expired subscriptions are retained for 180 days, after which inactive cloud data may be purged. Local data on your devices is not deleted.
• Free accounts that remain inactive for 12 consecutive months may have their cloud-synced data purged following advance email notice.
• You may request complete account and cloud data deletion at any time directly within the app settings.

6. Subscriptions, Payments, and Cancellation

6.1 In-App Purchases

Paid subscriptions (Standard, Pro, Premium) are offered through Apple App Store and Google Play on a monthly or annual recurring basis. Pricing is displayed in your local currency in the app at the time of purchase.

6.2 Automatic Renewal

Subscriptions automatically renew unless auto-renew is disabled at least 24 hours prior to the end of the current billing cycle. Your store account will be charged within 24 hours prior to renewal.

6.3 Managing and Canceling Subscriptions

You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings. Canceling takes effect at the conclusion of the current billing period, and no partial refunds are provided for remaining days.

6.4 Refunds

All billing, charges, and refund requests are handled exclusively by Apple or Google under their respective store terms. We cannot process refunds directly.

7. User Content and Acceptable Use

You retain full ownership of all flashcard texts, images, and content you create. You agree not to use the Service to store or transmit content that violates any applicable law, infringes third-party intellectual property, or contains malicious code.

8. Intellectual Property

UlarCard, its design, source code, logos, and documentation are the intellectual property of UlarioSoft. Open-source components used within the Service are governed by their respective licenses (see Open Source Licenses).

9. Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ULARIOSOFTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law principles. If these Terms are translated into other languages, the English version shall govern in the event of any discrepancy.
